Congressman Flood, Bipartisan FSC Members Press SEC Chair Gensler on Inconsistent Bitcoin Regulation

September 26, 2023

WASHINGTON, D.C. – Today, U.S. Congressman Mike Flood wrote U.S. Securities and Exchange Commission (SEC) Chair Gary Gensler along with House Financial Services Committee (FSC) Members, including Congressman Wiley Nickel (D-NC), Congressman Tom Emmer (R-MN), and Congressman Ritchie Torres (D-NY). In their letter to Chair Gensler, the Members of Congress highlighted the importance of consistent treatment of spot bitcoin products.

“During your time at the SEC, you have consistently stated that digital asset firms should ‘come in and register’ with the SEC,” wrote the Members of Congress. “Market participants have relied on your statements and have filed applications for a regulated spot bitcoin ETP. Following the Court of Appeals’ decision, there is no reason to continue to deny such applications under inconsistent and discriminatory standards.”
